Crow Pit Gravel Mining CUP - Rapid Response Plan
This plan is drafted in response to condition #4 of Resolution 25-23 authorizing a conditional use permit for an expansion of the Crow Pit and the operation of a sand and gravel mining use.
The goal of the Rapid Response Plan is to offer a clear, effective, and efficient path to address compliance issues in as timely of a manner as feasible.
1. Key points of contact for general pit compliance issues, questions or complaints:
a. Official complaints should be emailed to: Planning@greenfieldmn.gov. This email is received by the appropriate city staff and checked during business hours which are currently Monday through Thursday 7:00 am to 5:30. Complainants are held confidential per Minnesota Statute.
b. For reference, the Primary City Contact is the Zoning Administrator. The current zoning administrator is Daniel Van Holland - Email: dvanholland@greenfieldmn.gov Phone: 763-477-6464
c. Complaints, questions, or concerns can also be emailed directly to the operators of the Pit. This email goes directly to key staff with the pit who can address urgent matters: crowpitrapidresponse@superiorsand.net
d. For issues related to roadway safety and traffic matters that are of a non-emergency, contact the Hennepin County Sheriff Non-Emergency number at: 952-258-5321
e. If this is a life safety emergency matter call 911.
2. Process for assigning responsibility for follow up. Complaints will be received by the city and promptly communicated (without complainant information) to the Pit management team. Appropriate follow up will be determined by the Zoning Administrator.
a. Staff will first seek to validate the complaint including a review of submitted materials, potential site visit as warranted, conversations with the Pit Manager, and follow up with the complainant as needed.
b. If violation exists, an official notice of violation will be documented and sent to the Pit Manager and ownership as per 152.020 of the City Zoning Code.
This process takes time and is managed by the city along with other zoning and land use violations in the city. It will be addressed in as timely manner as possible.
3. Mitigation steps. The City will work with the Pit management team to address the violation and mitigate any concerns in a reasonable manner. In the event that violations persist, the City will proceed with proper recourse as identified in the zoning code section 152.020 subpart (H) (3). Potential recourse may include penalties, stop work orders, or commencing a process to consider revoking the CUP among others.
4. Communication and reporting out. Upon completion of the review and determine a proper mitigation path, staff will provide the complainant with the follow up actions and will notify the complainant when the violation case is closed. The complaints will be logged in a database and reported out to the City Council on a regular basis as determined by the volume of issued. logging the volume of complaints, staff time devoted to responding, escrow balance and average response times.
5. What needs to change with the Rapid Response Plan (RRP). The RRP is subject to change as it is a new process for the City. When the plan is changed it will be noted on the footer of the document and reposted to the project web site.
